The article discusses the U.S. Supreme Court's (USSC's) ruling in the case Minneci v. Pollard which deals with injured prisoner Richard Pollard and the reported balancing of the American separation of powers doctrine and right-remedy principles in connection with employees of private prisons who violate constitutional laws. The Eighth Amendment to the U.S. Constitution is mentioned, along with the 1972 USSC case Bivens v. Six Unknown Named Agents of Federal Bureau of Narcotics.
