- Abstract
The Higher Regional Court of Cologne has ruled that there is no claim for damages against a platform operator due to the scraping of personal data. The case relates to an incident on the Facebook platform in April 2021, where mobile phone numbers, names, Facebook IDs, gender, and places of residence of users were obtained and published. The court found that users who had set their data as "always public" cannot claim non-material damages, as they had already consented to the publication by agreeing to the platform's terms of use. Furthermore, a user who claims to have suffered a loss of control due to the publication of their phone number must provide concrete evidence.
