Use of Trade Mark in the Title of a Book.
- Abstract
The article discusses a court case in the Netherlands regarding the use of a trademark in the title of a book. The court determined that the use of the trademark in the title did not infringe the trademark rights of the owner. The court found that the title of a book is not a distinctive sign used by a publisher to indicate the origin of the goods. The court also concluded that the publisher did not derive undue benefit from the trademark and that there was no detriment to the distinctive character or reputation of the trademark. The appeal against the court's decision was dismissed by the Supreme Court.
