- Abstract
This work analyses the interpretations of the brazilian and american juridical systems about the debate on the hypotheses of search and seizure with no search warrants in drug trafficking cases. The juridical valuation of the discretion in police's activities in such cases demand an analysis on the fundamental rights that could be affected, mainly the right to privacy, protected by the fourth amendment in the United States, and by the fifth article of the Federal Constitution in Brazil. Through the contrast with the american constitutional debate, this work aims to reflect on the acting of the brazilian constitutional court before the institutional patterns of police violence that do not match the current constitutional order.
