"OBTAINING" THE RIGHT RESULT: A NOVEL INTERPRETATION OF THE COMPUTER FRAUD AND ABUSE ACT THAT PROVIDES LIABILITY FOR INSIDER THEFT WITHOUT OVERBREADTH.
- Authors
Jakopchek, Kevin
- Abstract
The author argues that the U.S. Computer Fraud and Abuse Act (CFAA) is designed to update property protections for a changing world since traditional American laws regarding trespass, burglary, and larceny are not sufficient to address issues related to computer misuse. Digital theft, U.S. legal remedies, and differing interpretations of the CFAA by U.S. circuit courts are assessed. Liability theories, concerns about overbreadth, and the U.S. National Stolen Property Act are examined.
