- Abstract
The article explores the concept of the "right against risk imposition" and the challenges in defining and understanding this right. It discusses two approaches: the Risk Thesis and the High Risk Thesis, both of which have limitations. The author suggests revisiting the original Risk Thesis as a more comprehensive approach. The text also discusses the ethical implications of risk imposition and the role of intentions in determining the moral difference between actions. It introduces the concept of normic risk and argues for a pluralist approach to understanding risk. The article concludes by addressing the issue of distributed risk and how the Normic High Risk Thesis can provide a more nuanced understanding of rights and risk imposition.
