- Abstract
The article discusses a proposed measure for streamlining the claim construction process in patent litigation in America as of 2012, and it mentions a de novo standard of appellate review in the U.S. Court of Appeals for the Federal Circuit. U.S. patent laws and reversals of judgments are examined, along with the nation's Patent Act of 1952. The U.S. patent claim construction cases Markman v. Westview Instruments Inc. and Cybor Corp. v. FAS Technologies Inc. are assessed.
