- Abstract
The article presents a study which investigates the legal and technical interaction between patent and plant variety rights. It discusses the concept of "plant varieties" and presents the examination of the European Patents Organisation (EPO) regarding the patentability of hybrid and transgenic plants. It also explores the relationship between patent and the rights of the plant breeders in the context of the international Trade-related Aspects of Intellectual Property Rights Agreements (TRIPS).
