- Abstract
This article presents information on recent court decisions on insurance contracts containing arbitration clauses as of September 1988. In Cady vs. Allstate Insurance Co. case, an insured was struck by an auto driven by an uninsured motorist. The insured's wife witnessed the accident. Together, they filed an uninsured motorists' claim against their insurer. The insurer invoked an option within the insurance contract permitting the issue of coverage and damages to be submitted to binding arbitration. The insured failed to object to the arbitration. A board of arbitrators denied the wife's claim. That denial was confirmed by a trial court.
