- Abstract
As from 28 March 2012, ship arrest in Spain is regulated by the Geneva Convention of 12 March 1999 as complemented by the new twenty-sixth final provision of our Civil Procedural Act. This is, from this date onwards, the only regime applicable to ship arrest whatever the flag of the vessel arrested may be. Due to its strategic position, as an entrance to the Mediterranean from the Atlantic and vice-versa, and due to its thousands of kilometers of seashore, Spain has traditionally been an important jurisdiction for ship arrest. From the analyses of the new Convention we conclude that, contrary to what would be thought from its preliminary reading, the new regime will limit the scenarios in which it is possible to arrest a ship in our country
