- Abstract
Judicial and extrajudicial proceedings are supposed to resolve particular disputes between the parties and they are always based upon the legal acts. In addition, the process, the main actors, decisions, remedies, facts and other important issues that are related to the proceedings are provided in appropriate legal acts. But, beside them, these procedures are also based upon certain principles. In this paper, we will firstly present the principles encountered in the international commercial arbitration procedure (which, by their nature derive from the civil procedure) and for research and comparative purposes, we will compare them with similar principles that apply in the criminal procedure.
