- Abstract
Collective bargaining is a complex and contradictory process. Its contradiction arises from various social interests and the position of labor in the capital. Workers are organized in trade unions, whereas employers are organized in employers' associations. Both forms of organization have social power, which plays an important role in collective bargaining. Governments as a third social partner also possess social power, which originates from the nature of the institution itself. This power of government is institutional, as it derives from government interventions regulated by constitution and laws. The government emerges as an employer of public sector employees, hence, in this regard, it is a subject of collective bargaining. In this paper we provide an explanation of collective bargaining in a broader sense and, more specifically, in the process of social dialogue, as an expression used in labor law. In terms of definition, collective bargaining has several approaches. However, all definitions specify that it is a procedure that should lead towards reaching a collective agreement. We also treat the history and theories of the legal nature of collective bargaining in general, as well as in the Republic of Northern Macedonia. Specifically, this paper treats the normative acts in the field of labor law which regulate collective bargaining with all the benefits and disadvantages, on which at the end of this paper we give some recommendations for improving particular situations.
