- Abstract
The Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization to the Convention on Biological Diversity, dated October 29, 2010, is an international agreement that seeks to establish a transparent legal framework to ensure the fair and equitable participation in the benefits derived from the utilization of genetic resources and the associated traditional knowledge. The Protocol requires that participation be carried out on the basis of mutually agreed conditions and establishes that access will be subject to the prior informed consent of the Party providing the resources. It also provides for the creation of cooperation mechanisms to financially assist developing countries and monitor compliance with the legal obligations of the Protocol. The Protocol will enter into force 90 days after the receipt of the 50th instrument of ratification, acceptance, approval, or accession.
