- Abstract
The article discusses a U.S. Supreme Court case National Association of Home Builders v. Defenders of Wildlife. It is noted that under the Clean Water Act, the National Pollutant Discharge Elimination System (NPDES) allows the administrator of the Environmental Protection Agency (EPA) to issue permits for the discharge of any pollutants into the navigable waters of the U.S. The Supreme Court has held that the EPA need not consult with the Fish and Wildlife Service before delegating the authority.
