- Abstract
The article focuses on the U.S. Patent and Trademark Office's movement towards a more administrative role. It is indicated that the PTO has a lack of substantive rulemaking authority. Moreover, this paper deals out into three parts. It reviews the evidence of dysfunction, discusses the area of procedure and draws up realistic near-term possibilities for the path forward, which concentrating the link between PTO and the administrative state in the area of the patent law.
