The Centers for Medicare & Medicaid Services Tackle Nurse Staffing Rule: Fairy Tale Ending or Endless Litigation?
- Authors
Davitian, Leigh
- Abstract
The article discusses the Centers for Medicare & Medicaid Services' (CMS) minimum staffing rule for long-term care facilities. The rule requires facilities to meet phased-in staffing requirements, including a total of 3.48 hours per resident day (HPRD) of nursing care, with a minimum of 0.55 hours per day consisting of registered nurse (RN) care and 2.45 hours per day consisting of nurse aide (NA) care. Facilities must also have an RN onsite 24/7. The rule will be implemented gradually over several years, and facilities can apply for exemptions under certain circumstances. The article acknowledges controversies and legal battles surrounding the rule but emphasizes the importance of proactively working towards meeting the requirements.
