- Abstract
The article discusses a German court case involving German transport company Fraport and examines its public forum doctrine. The First Senate of the Federal Constitutional Court (FCC) examined the applicability of the constitutionally granted communication-related rights under privatized public spaces. The FCC introduced the concept of public forum and decided that an enterprise owned by private shareholders and the state is directly bound by the fundamental rights.
