- Abstract
The article discusses the U.S. Court of Appeals for the Second Circuit's ruling in the 2012 case NML Capital Ltd. v. Republic of Argentina which deals with bond default, debt swaps, and the reported inadequacy of remedies under the U.S. Foreign Sovereign Immunities Act of 1973. Writs of certiorari and injunctions are addressed, along with Argentine sovereign debt litigation, and the legal rights of bondholders. Equitable remedies, debt restructuring, and contempt sanctions are examined.
