The article discusses the collision between the expansion of trademark doctrine to cover new uses of trademarks online and the misapplication of the "initial interest confusion" doctrine in the Ninth Circuit. Topics include the evolving landscape of online advertising and trademark use; the application of the "initial interest confusion" doctrine to online settings; and a comparison of two Ninth Circuit opinions (Playboy Enterprises, Inc. v. Netscape Communications Corp.).
