The article discusses the impact of environmental regulations on the shipping industry as seen in the decision of the Court of Justice of the European Communities or the European Court of Justice (ECJ) in the case Commune de Mesquer v. Total France SA and Total International Ltd. It reveals that the case is asking for compensation for the oil pollution damage caused by the sinking of the vessel, M/S Erika because of structural hull failure.
