- Abstract
This study aimed to clarify the concept of the modern state as defined by Wael Al-Halaq and the methodological tool he used to approach the subject. The study sought to clarify the characteristics of the form of the modern state. Al-Hallak specified five characteristics: the state as a historical product, sovereignty as a metaphysical essence, legal legislation and legitimate violence, bureaucratic apparatus, mental rationalization, social domination and politicization. The study also dealt with the moral criticism Al-Hallak addressed to the modern state, including: criticism of the principle of the separation of powers, the separation of the legal and the moral in the state, the concept of sacrifice, and the social control of the human self.
