- Abstract
The article discusses whether a risk of relapse can lead to a current disability under the Employee Retirement Income Security Act of 1974 (ERISA). It mentions the ruling of the U.S. Court of First Circuit in the case of Doctor Julie Colby who became addicted to the drug which she used for the treatment of patients and then was offered with employee benefit plans administered by the Union Security Insurance Co. & Management Co. (USIC). It also adds the risks of relapse.
