- Abstract
The article explores the validity of modern Sunday closing laws also tagged as Blue Laws under the establishment clause. It was disclosed that such law originated from England, and was implemented in colonial America in an effort to protect the Christian Sabbath as mandated by the Fourth Commanded. Meanwhile, it was suggested that in order to determine the constitutionality of blue laws, it is vital to examine its purpose and its effect. Moreover, it was stated that the Establishment Clause was meant to protect citizens against any law which chooses any religious custom, practice or ritual which otherwise penalizes a person for not observing it.
