- Abstract
The article discusses the legal status of gestational surrogacy in the U.S. Brief information on the assisted reproductive technologies (ART) is presented which includes in vitro fertilization (IVF), surrogacy, and artificial insemination. It informs about the various approaches of states and legal organizations that have been recommended regarding surrogacy. It focuses on the court case In re Baby M and further discusses the arguments against enforcement of gestational surrogacy agreements.
