The article focuses on decision of the U.S. Court of Appeals for Ninth Circuit in the case Fox Television Stations, Inc. v. Aereokiller LLC which held that Internet video retransmitters are not eligible for the Copyright Act's section 111 compulsory license. It mentions legislative history behind section 111 and the current regulatory backdrop of telecommunications. It also mentions U.S. Supreme Court's decision in American Broadcasting Companies, Inc. v. Aereo, Inc.
