- Abstract
The article focuses on two jurisprudential policies which the author believes compete against each other and causes the U.S. court system to overwork. It mentions the prohibition of contingency-free mediation and the alternative dispute resolution (ADR) effort to unburden the courts on the other. It examines whether burdens on courts could be eased by relaxing the contingency-free ban. It also talks about the varieties of contingency-fee arrangements (CFM) and their benefits for courts.
