- Abstract
The article argues that durational-residence requirements for in-state tuition at public colleges and universities in the U.S. violate the fundamental right to travel. It contends that in the Saenz versus Roe case, Saenz's portability distinction is deceptive and should not preclude the decision's reasoning from applying to requirement for college tuition. It asserts that courts should apply strict scrutiny in evaluating such durational-residence requirements.
