Abstract
The article discusses a court case wherein the European Court of Justice (ECJ) declared that Great Britain failed to fulfill its obligations under Article 53 of Council Directive 96/29/Euratom laying down basic safety standards for the protection of the health of workers and the public against the dangers arising from ionising radiation. The British government imposed an obligation to intervene only if a situation results from an activity for the exercise of which a licence was granted.
