The article discusses the effect of the American doctrine of discovery on native land rights in the former British colonies of Canada, New Zealand, and Australia. It mentions the 1823 decision made by former U.S. Chief Justice John Marshall on Johnson v. McIntosh case regarding Indian land rights wherein the U.S. Supreme Court refused the favorable view of indigenous land rights. It presents a discussion of the United Nations (U.N.) declaration on the rights of indigenous people.
