- Abstract
The 2001 Cape Town Convention on International Interests in Mobile Equipment and the Aircraft Protocol have proven to be successful in terms of securing financiers' interests and consequently facilitating aircraft finance transactions. Findings show that this Convention has made more financing available with less cost for airlines. Upon the removal of sanctions against Iran under the Joint Comprehensive Plan of Action, Iranian airlines have stepped in with numerous deals from aircraft manufacturers. With a view to profiting from the benefits of the Cape Town Convention, and probably due to the pressure from potential financiers, there has been some effort from the Iranian government to accede to the Convention. However, many doubts have arisen concerning the considerable differences between the provisions of the Convention and Iranian law so that the ratification of the Convention by Iran's Parliament is uncertain. This article analyses the discrepancies and compatibilities of Iranian law with the Convention to give a clear view of the legal impediments to Iran's accession to the Cape Town Convention and the Aircraft Protocol.
