- Abstract
Imagine lying down on the concrete floor of a freezing holding cell with only a Mylar blanket. You have no access to showers, toothpaste, toothbrushes, or soap. You have no way to wash up after using the toilet or changing your child's diaper. An officer approaches you with a piece of paper with writing you cannot understand. "Sign it, and we will send you home." The problem is "home" is what you are running from--gangs threatening to kill you because your husband was a police officer.1 Holding this piece of paper, you do not realize how great of an impact speaking to an attorney could have on your case. Unfortunately, you will never have an attorney because you cannot afford one and neither the U.S. Constitution nor legislation provide you an attorney. While many argue for the guaranteed right to counsel for specific groups of immigrants at specific points of the immigration process, sometimes the forest is lost through the trees: Why not provide the guaranteed right to counsel for all immigrants at all stages of the immigration process?
