- Abstract
Court orders according to section 64 of the German penal code require a causality between substance abuse and the offence. However, there is little empirical evidence on substance use immediately before offending. This investigation is based on routine data of 733 subjects in time-limited (max. duration 2 years) detention between 2014 and 2015. It looked at criminal burden, main substance related diagnosis and substance use before offending regarding both the type of substance and the clinical syndrome. Consuming alcohol or opioids had a high correlation with an alcohol or an opioid related disorder; using amphetamines was often related to multiple drug abuse. Violent offenders had often consumed alcohol while illicit drug users had primarily committed acquisitive crimes. The criminal burden differed: amphetamine consumers were younger at the time of their entry in the Central Federal Register of Convictions (BZR). Subjects with alcohol intoxication had committed more serious crimes and had more records in the BZR.
