- Abstract
The article discusses the recoupment of compensation in relation to the U.S. Federal Deposit Insurance Corporation's promulgation of rules regarding Title II of the nation's Dodd-Frank Wall Street Reform and Consumer Protection Act as of November 2012, focusing on an analysis of the liability of financial executives for the failure of nonbank financial institutions. The author argues that a disconnect between the causation for a failure and recoupment leads to overdeterrence.
