- Abstract
The article reports that videotaping negotiations between attorneys will both induce more ethical behavior ex ante and facilitate enforcement ex post. Topics discussed include American Bar Association's (ABA) mandate that negotiations be videotaped; nondisclosure agreements (NDAs) binding the attorneys, conditional on substantial compliance with ethical rules; and ways in which videotaping negotiations can bolster weak enforcement by making available evidence usable in ethics proceedings.
