- Abstract
The article discusses the court case 14 Penn Plaza LLC v. Pyett, wherein a union asks through arbitration provision in a collective bargaining agreement (CBA) if a member's right could be waived to pursue federal law remedy in the U.S. It notes that the effectivity of labor arbitration for the resolution of statutory claim is questioned if the union is involved. The Supreme Court (SC) holds that the union can waive union member's statutory right provided that arbitration procedure is involved.
