The Movement Toward Early Case Handling in Courts and Private Dispute Resolution.
- Authors
LANDE, JOHN
- Abstract
The article explores early case handling (ECH) as a general phenomenon in dispute system design (DSD) theory and practice. It says that ECH processes extend the potential of efficiency from conscious efforts to exhibit the process of concentrating on the critical aspects of the dispute. It encourages practitioners and policymakers to use the experimentation of ECH processes when needed. An overview of the ECH in courts and private dispute resolution is presented.
