- Abstract
The nature of the educational disciplinary power, the discretionary right of teachers and the space reserved by the inherent defects of the legal system determine the flexibility of the disciplinary right of teachers in primary and secondary schools. The flexibility of the disciplinary right of teachers in primary and secondary schools is embodied in four aspects: the principle of the flexible disciplinary action, the determination of the disciplinary scope, the choice of the disciplinary form and the application of the summary procedures. Teachers in primary and secondary schools cannot overstep the limits of the purpose, result and form of the educational discipline when they exercise their disciplinary right flexibly.
