- Abstract
The article discusses the need for the federalization and integration of the law of personal property security interests with the Bankruptcy Code. It cites why a federal approach to sameness of personal property security law makes more sense than a uniform state approach and provides the advantages of integrating article 9 of the Uniform Commercial Code with the Bankruptcy Code. It points out that federal law governs over state law and the federal approach offers a distinct advantage over the uniform state approach to the law governing commercial transactions. It suggests that federalizing personal property security law can be commended as an experimental first step to federalization of all commercial laws covered by the Uniform Commercial Code.
