- Abstract
The article discusses judicial and administrative review of government contract awards in the U.S. The extent to which a failed bidder can stop the ongoing award process pending an authoritative determination of the validity of the proposed action is examined. Also discussed is the manner in which unsuccessful bidders seeking declaratory or injunctive were able to obtain judicial review of contract award decisions. It explores an overlap between administrative and judicial review in the case M. Steinthal & Co. v. Seamans. The author asserts that any reform effort should aim to improve the rules of contract awards and increase the legal protection of failed bidders who can prove that the decision was improper.
