- Abstract
The article deals with four cases concerning prisoner disenfranchisement. It notes that courts handling prisoner disenfranchisement cases are likely to value the constitutionality of the legislative restrictions on the voting rights of prisoners as there are no political costs involved. In the South African case Minister for Home Affairs v. National Institute for Crime Prevention and Reintegration of Offenders (NICRO), in which the Constitutional Court was not convinced that the disenfranchisement of prisoners had a legitimate basis.
