- Title
Die Paradoxie der Zeugenschaft: Lebensgeschichte als Konstruktionselement der Interaktionspraxis in Gerichtsverhandlungen.
- Authors
Benkel, Thorsten
- Abstract
The article discusses the paradox of testimony and life story as an element in court. Aspects like the insufficiency of inner experience, paradox testimony, biographical refractions are reviewed. The author elaborates on tendencies of the witness to achieve a logical coherence, like validation, extenuation or stringency. Literary structures such as positivism in narration and the construction of the observer position are analyzed. The article concludes, that when a witness testifies, he does so with constant self-regard as part of a "stream of consciousness" thought process. And while basically not confessing on his own behalf, he nonetheless has to testify under oath.
