- Abstract
The article reports on the resolution of the legal case of the State of Maine vs. Stephen L. Johnson. In the case the Court of Appeals held that the Settlement Acts made ordinary Maine law apply at both non tribal and tribal facilities that discharge onto tribal waters. The Penobscot Nation and the Passamaquoddy Tribes had argued that the Environmental Protection Agency had erred in approving the state of Maine's discharge permitting program pursuant to 33 U.S.C. Section 1342.
