Abstract
The article states that the indictment against Michael Martinez for first-degree murder was upheld in United States vs. Michael Martinez. The San Juan Pueblo Indian referred to the Federal Death Penalty Act and argued that there is a five-year limitation on investigation and prosecution of crimes in Indian Country and that his crime is not a capital offense. Other cases mentioned include United States v. Manning and United States v. Gallaher.
