- Abstract
The article discusses the race requirement imposed by the U.S. Patent and Trademark Office (USPTO) on biotechnology (biotech) patents. It is said that examiners at the USPTO have been requiring applicants to indicate racial categories in the claims sections of some the biotech patent applications. It notes that race is important to a patent claim as it serves as the legally operative section of a patent that determines the territory that it covers. One problem resulting from such requirement is the concept that race is a genetic category.
