- Abstract
The article discusses various legal aspects of internships in America in relation to the U.S. Fair Labor Standards Act (FLSA) which governs minimum wage and overtime in America, focusing on whether an "intern" might meet the legal definition of an "employee" for FLSA purposes. The U.S. Supreme Court's ruling in the 1947 case Walling v. Portland Terminal Company, which deals with the scope of coverage under the FLSA for trainees, is mentioned. The U.S. Department of Labor is also examined.
