ORGANIC CROPS, GENETIC DRIFT, AND COMMINGLING: THEORIES OF REMEDY AND DEFENSE.
- Authors
Mitchell, Shené
- Abstract
The article focuses on the plight of organic growers and farmers who have to pay damages for patent infringement as their fields were contaminated by patented seeds due to which they suffer market loss as they have to sell their organically raised goods at lower prices for conventional goods. It mentions several legal arguments that these organic farmers can employ to gain the economic loss caused by genetic drift and avoid infringement liability that leads to genetic drift.
