- Abstract
Occupational accidents are events that are frequently encountered in working life and that may result in the death of the worker as well as the physical and mental harm. Social Security Institution provides performance to the insured and the beneficiaries when the insured suffer a work accident. After the financing of the performances offered is covered by the Institution, the employer, who is found to be at fault in a work accident, is revoked at the rate of his fault. Likewise, the payments made by the Institution to the insured person who suffered a work accident are revoked to the employer who does not fulfill the notification obligation. The scope of our work consists of the employer's liability conditions in the Social Insurance and General Health Insurance Law No. 5510. In our study, it is aimed to examine the employer's responsibility in terms of work accident in terms of Turkish social security law by making use of the Institution's practice, relevant legislation, judicial decisions and the views in the doctrine.
