The article focuses on the theories that support novel arguments for innovator and co-promoter liability in the pharmaceutical litigation context and proposing business strategies that could help mitigate these emerging risks. Topics discussed include tort doctrine that limits product liability, U.S. Supreme Court cases Wyeth v. Levine, and PLIVA Inc. v. Mensing and regulations from the U.S. Food & Drug Administration (FDA) for the generic manufacturers.
