- Title
Lead Paint: Mass Tort Litigation and Public Nuisance Trends in America.
- Authors
Schaefer, Fredrick C.; Nykiel, Christine
- Abstract
The article focuses on the mass tort litigation in the U.S. concerning lead paint. Though it has always been a debate on whether tort law is intended to redress individual or societal wrongs, manufacturers of products that caused harm to any victim should be held liable without a right of contribution. The success of plaintiffs in their suits depends on its adherence to the concept of causation and how the jurisdiction applies the public nuisance theory.
