- Abstract
The article discusses aspects of a person's right to privacy. It argues that the criminal punishment for the payment of money in return for sex is unconstitutional, and violates the right to conduct one's sexual affairs privately. It provides an analysis of various approaches in criminalizing prostitution, and it offers information about the U.S. Supreme Court's five step substantive due process analysis in dealing with the issue. It concluded that criminal penalty for the said activity is an unconstitutional violation of one's right to privacy.
